These Terms & Conditions of Sale explain how BC Greenhouse Builders Ltd. and its affiliates (“BCG,” “we,” “us”) sells, fabricates, delivers, and supports our custom greenhouse products. Because our greenhouses are built to order, certain policies differ from standard retail purchases. We encourage customers to review these terms carefully and contact us with any questions before placing an order.
1. Entire Agreement
These Terms & Conditions of Sale form part of the purchase agreement between BC Greenhouse Builders Ltd. and the customer, together with the applicable Warranty and Order. These terms apply to all customer transactions unless otherwise agreed to in writing by both parties.
2. Changes to Confirmed Orders
Once an order is confirmed, any changes may result in change-order fees, additional charges, or schedule adjustments. All changes and any associated pricing adjustments must be approved in writing by both parties before work proceeds.
3. Installation Scope & Expectations
Installation is not included unless explicitly stated in your quote.
Unless otherwise noted, installation services:
- Require a prepared foundation specific to the greenhouse dimensions provided to you by your Greenhouse Expert
- Do not include foundation work, electrical, plumbing, or flashing
Any inclusions or exclusions will be clearly identified in your quote.
4. Fabrication & Delivery Timelines
Fabrication and delivery timelines are estimates and may change due to factors beyond our control, including supply chain disruptions, weather, or carrier delays.
BC Greenhouse Builders is not responsible for losses or expenses arising from fabrication delays, shipping delays, or failure to receive advance notice of such delays.
5. Shipping & Freight
Orders are shipped using carriers coordinated by BC Greenhouse Builders unless otherwise specified.
Freight costs include applicable customs and duty charges unless noted
If shipment is delayed at the buyer’s request, or if incorrect or incomplete delivery information is provided, any resulting storage or additional costs are the buyer’s responsibility
6. Inspection & Acceptance of Goods
The buyer is responsible for receiving delivery with appropriate manpower and equipment unless otherwise noted.
Upon delivery, the buyer must:
- Inspect all goods before installation
- Note any damage on the delivery receipt
- Provide written notice and photographs of damage to BCG
All delivery-related claims must be submitted within five (5) business days of delivery. Failure to do so constitutes acceptance of the goods in satisfactory condition.
7. Product Use & Liability
BC Greenhouse Builders is not liable for defects or failures resulting from:
- Normal wear and tear
- Improper use or installation
- Unauthorized modifications
- Negligence
- Acts of God or abnormal conditions
Use of any product outside the scope outlined in the quote or warranty voids all liability.
8. Cancellations, Returns & Modifications
Due to the custom-built nature of our products:
- Orders are final sale
- Cancellations, returns, or modifications require written approval from BCG
9. Payment Terms
Standard payment terms are:
- 25% deposit due upon order confirmation
- 75% balance due prior to shipment
Alternate terms must be documented in writing.
10. Taxes & Duties
Provincial Sales Tax applies to orders within British Columbia GST or HST applies to all Canadian orders. Other provincial, state, or international taxes may be the buyer’s responsibility. BC Greenhouse Builders is not responsible for taxes assessed after the sale.
11. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the Province of British Columbia, Canada. Any disputes will fall under the jurisdiction of British Columbia courts.
12. Excluded Services
Unless otherwise stated, orders do not include:
- Site preparation
- Building permits
- Electrical or plumbing services
- Waste or debris removal
13. Warranty Limitations
Warranties do not include reimbursement for labor, time loss, or indirect costs incurred due to manufacturing defects or delays. Full warranty terms are provided separately.
